1. Agreement to Terms
These Terms & Conditions ("Terms") govern your use of services provided by Lawn Care Web Design, operated by Nelson Pearce ("we," "us," "our"). By booking a call, purchasing a plan, or otherwise engaging our services, you ("client," "you") agree to these Terms. If you do not agree, please do not use our services.
2. Our Services
We design, build, host, and maintain websites for lawn care and landscaping businesses, and provide related SEO and content services. Specific deliverables, timelines, and scope for your project will be discussed and confirmed during onboarding.
3. Billing & Month-to-Month Plan
Our core website plan is offered on a month-to-month basis — there is no long-term contract. You are billed monthly for as long as your plan is active, and you may cancel at any time as described in the Cancellation section below. There is no early termination fee for canceling a month-to-month plan.
Billing begins once your website build or service delivery has started, and recurs monthly thereafter unless you cancel.
4. Optional Add-On Services
We offer optional add-on services that may be added to your plan at any time, including:
- Review Generation Service — billed monthly, in addition to the core plan, for as long as the add-on remains active.
- Homeowner Data for Direct Marketing — billed per data point at the rate quoted at the time of purchase, for the specific data delivery requested.
Add-ons can be added or removed independently of your core plan, and are billed according to their own terms as described above.
5. Refund Policy
If you have a concern about work that was delivered, or believe something was billed in error, please email us at hello@lawncarewebdesign.site so we can look into it. We want you to be satisfied with what you receive, and we're glad to work with you to resolve legitimate issues — but delivered work and delivered data are not eligible for refund simply due to a change of mind.
6. Cancellation
Because the core plan is month-to-month, you may cancel at any time by emailing hello@lawncarewebdesign.site or calling/texting (833) 523-9707. Cancellation stops future billing; it does not retroactively refund any month already billed or any work already delivered, consistent with our refund policy above. Your website may be taken offline or transferred following cancellation, depending on your hosting arrangement at the time.
7. Client Responsibilities
To deliver your website and content on schedule, we rely on you to provide accurate business information, timely feedback, and any photos, logos, or licensing/credential details you want featured on your site. Delays in providing this information may delay your project timeline.
8. Website & Content Ownership
Once your website is built and active on the plan, the domain and site content are yours. Your monthly plan covers ongoing hosting, security, updates, and SEO content — it is not a fee required to "unlock" ownership of a site you've already paid to have built and maintained.
9. SEO & AI Search Results Disclaimer
We build every site with local SEO and AI-search-friendly structure and content from the start, and we provide ongoing content as part of the plan. However, search engine rankings and AI search visibility are influenced by many factors outside our control, including competitor activity and changes to search engine and AI platform algorithms. We do not guarantee specific rankings, traffic, lead volume, or placement in AI-generated answers.
10. Limitation of Liability
To the fullest extent permitted by law, Lawn Care Web Design is not liable for indirect, incidental, or consequential damages arising from your use of our services, including lost business, lost leads, or lost profits. Our total liability for any claim relating to our services is limited to the amount you paid us in the three (3) months preceding the claim.
11. Homeowner Data Add-On Terms
Homeowner data delivered through the data add-on is provided for the client's own direct marketing use. The client is solely responsible for complying with all applicable laws regarding the use of this data, including telemarketing, text messaging, email marketing, and Do Not Call regulations. Data add-on purchases are billed per data point at the rate agreed at time of order and are non-refundable once the data has been delivered, per our refund policy above.
12. Changes to These Terms
We may update these Terms from time to time. Continued use of our services after changes are posted constitutes acceptance of the updated Terms. The "last updated" date at the top of this page reflects the most recent revision.
